EPA Reverses Key Lead Abatement Rule: Children at Risk

"There is more than a little irony here. The EPA--the same agency that took lead out of gasoline--is now weakening any attempt to eliminate the most important remaining source of lead poisoning: household paint and dust."

So spoke Dr. Herbert L. Needleman, one of the nation's premiere experts on the impact of lead poisoning on children. Dr. Needleman spoke with BushGreenwatch upon learning that the Environmental Protection Agency has quietly removed the requirement that only certified contractors using workers trained in lead-safe practices may do remodeling or renovation in buildings constructed before 1978.

According to internal briefings obtained by Public Employees for Environmental Responsibility (PEER), President Bush's new EPA Administrator, Stephen Johnson, has scrapped that requirement in favor of a voluntary approach.[1] Dr. Needleman described the voluntary approach as "a strategy that has never worked in lead abatement."

An EPA spokesperson said the decision to switch to a voluntary approach was not made by Administrator Johnson, but would not say who did.

Citing EPA's removal of lead from gasoline as "the most important public health achievement of the past 30 years," Dr. Needleman said the one important remaining source is lead in the paint and dust of older housing. EPA estimates that some 1.4 million children under age 7—the prime developmental years--live in households where they are at risk of lead exposure.

Addressing the damage lead poisoning causes to children's brain development, Dr. Needleman, a professor of psychiatry and pediatrics at the University of Pittsburgh School of Medicine, and other physicians and lead investigators said that "as pediatricians who have seen the tragic consequences of lead poisoning close up, we are outraged at the quiet abandonment of a program that could eliminate this avoidable epidemic." The Centers for Disease Control estimates that 434,000 U.S. children under the age of 5 currently have blood-lead levels linked with serious developmental health consequences. Most of them live in the inner cities.

"The Bush Administration has walked away from the national goal of eliminating childhood lead poisoning by 2010," said PEER Executive Director Jeff Ruch. Ruch said PEER is working to organize a coalition to press for implementation of the "long-stalled regulations," and, if neccessary, take the issue to court.

Wal-Mart Stores Inc., the world's biggest retailer, has agreed to pay $11 million to settle federal allegations it used illegal immigrants to clean its stores, attorneys in the case said Friday.

Why is this here, well it shows you how BIG business and your goverment are alike. Your gov. took money from your SS and now is not going to pay it back and Wal-Mart hired illegals to pay less to them and never even offered the jobs to real Americans. Your on your own, believe it.

And just where well this $11,000,000 go? Where do all the moneys go that the gov. collects, like these. If they do collect it. I know they take my checks, but we never know if the money was ever paid. But we never hear that the CEO's that are fined ever pay thier money.

This was a big week in the struggle for fair judges. Senate Minority Leader Harry Reid led the Senate Democrats down the Capitol steps and pledged an all-out war against the Republican plot to break the Senate and stack the courts with partisan, corporate judges. Thousands of MoveOn members formed local teams and phoned in 26,692 calls to Senators across the nation. And hundreds of MoveOn members joined Senator Byrd and seven other leading senators to rally for fair judges in Washington DC.

It's time to take the battle for fair judges and democracy in the Senate to the air waves. The Republican plan calls for Dick Cheney to eliminate a centuries-old rule requiring federal judges to get broad support in the Senate -- they call his maneuver the "nuclear option." Moderate Republicans are nervous, because they know that Cheney's plan assumes that real people won't care about Senate rules, and won't pay attention. And we only need six Republican votes to win.

The key to victory is to prove that the public is watching. Together, if we can raise $250,000 today, we can put our new "Rubber Stamp" TV ad on the air nation-wide tomorrow--and run radio ads in the home states of moderate Republicans who could still go either way. Yesterday, we held a rally featuring Senator Byrd, the fiery 87-year-old Senator from West Virginia who became a progressive hero for his outspoken stance on the war in Iraq. In a raucous and energetic rally, Senator Byrd told hundreds of MoveOn members about the Republican outlook on the courts:

These instant Constitutional "experts" want to warp the Senate's Constitutional purpose with a witch's brew of half-truths, twisted logic and vicious attacks on American history. Why? Because they don't like the rules. They want to change the rules so they can pack the courts.

They want to change the rules in the middle of the game to get their own way. Who cares about the consequences for the rest of the country? Who cares about minority views in a free society?...

They want the Senate to rubber stamp their judges, just like they wanted the Senate to rubber stamp the wrong-headed war in Iraq!

This is a nation built by God-fearing people who want to preserve liberty. The people fear the policies of this White House and its judicial nominees. People are afraid for their basic rights.

Are we going to be muzzled by a majority that wants to silence us on all of these issues? Delay, deliberation, and debate may be a waste of time to some, but it's free speech and the American way to all of us who love our country.

The campaign to save our courts is growing at the grassroots, too.

Almost 350,000 of us have signed our national petition to oppose Bush's already-rejected, re-nominated, corporate judges.

And last week, we launched Operation Democracy--our neighbor-to-neighbor field network-- with 15,000 members gathering in 1,500 living rooms across the country to draw up local campaign plans to defend the courts. Yesterday, those local teams reported that they'd generated 26,692 calls to Senate offices around the country, and handed out 14,613 flyers to boot.

Operation Democracy teams found support in every corner of the country. Karen, a team member in Mobile, Alabama, reported that "It was good to know that the young people in Alabama, a very RED state, were very receptive and want to make a change."

This kind of grassroots ground swell is the last thing Republicans expected--they thought they could push the button on the "nuclear option" and no one would notice. New EPA Mercury Rule Called Illegal

With the long-awaited release yesterday of its new rules for reducing mercury pollution, the Environmental Protection Agency set off a firestorm of protest and controversy that is certain to wind up in the courts.

As expected, EPA announced new rules that would reduce mercury emissions from coal-fired power plants 20 percent by 2010, with a goal of 70 percent reduction by 2018. Environmental health and other groups assert that greater reductions could be achieved much more rapidly, and that EPA's decision will endanger the health of hundreds of thousands of newborn babies.

Mercury is known to harm the brain and nervous system, especially in infants. It can cause learning disabilities, attention deficit disorder and mental retardation. One in six U.S. women of child-bearing age is reported to have enough mercury in her blood to put a developing fetus at risk. [1] The primary means of exposure is through consumption of certain species of deep ocean fish, such as tuna and pollock.

The Bush Administration is proposing a "cap and trade" system, whereby a national limit on mercury emissions would be set, but in which individual power plants could trade emissions credits. This would mean some states would achieve reductions in mercury pollution while others would actually experience an increase.

John Walke, director of the air pollution program at the Natural Resources Defense Council, said this would result in enormous increases in mercury emissions in certain states. For example, an increase of 841% in California; 176% in Colorado; 241% in New Hampshire; and 56% in New Jersey. [2]

Martha Keating, a former mercury expert at EPA who is now a senior scientist at the Clean Air Task Force, joined others in saying that proper enforcement of the current Clean Air Act would be far more effective than the new mercury rule. "If the Clean Air Act was implemented as it should be, we would get significant reductions of mercury, upwards of 90 percent," she said on National Public Radio. "So [the new rule] in our mind is a rollback." [3]

"It is unconscionable EPA is allowing power companies to trade in a powerful neurotoxin--it is unprecedented and illegal," said William S. Becker, executive director of the bipartisan State and Territorial Air Pollution Program Administrators. [4] Becker also heads the Association of Local Air Pollution Control Officials.

Recent criticism both by the EPA's own inspector general and by the non-partisan Government Accountability Office alleged that EPA ignored scientific evidence in developing its mercury rule, and called for further analyses. A Washington Post article said Agency staff charged that Bush Administration political operatives set the framework of the rule in advance, to support industry's claim that installing the newest air pollution control technology would be too expensive. [5]

Because mercury pollution of the oceans is a global problem, the UN Environmental Programme held an international meeting in Nairobi last month in an attempt to set in motion a plan to reduce the trade, mining and emission of mercury. The European Union has already decided to phase out mercury-cell chlorine production and close the largest mercury mine in Europe (located in Spain).

But U.S. officials blocked any concrete actions, instead calling for self-regulation, more studies, more discussion. Noting that the EPA has defended its new rule by saying mercury pollution is a global problem and therefore tighter controls on U.S. coal-fired power plants wouldn't solve it, Michael Bender of the Ban Mercury Working Group--a coalition of 27 public interest groups from several nations--said "The Administration is talking out of both sides of its mouth. Today they are saying the only way to solve the U.S. mercury problem is through international action. Yet three weeks ago they hijacked the process and blocked development of a global strategy."

PBGC Will Assume Ground Employee Pension Plan at UAL

WASHINGTON-The Pension Benefit Guaranty Corporation(or the US gov.) today announced it is moving to assume responsibility for the pensions of more than 36,000 active and retired ground employees of United Airlines.

"United's pension plan for its ground employees is only 30 percent funded, the company has missed $363 million in legally required contributions, and management has repeatedly stated its intention to terminate the plan," said Executive Director Bradley Belt. "This action was necessary at this time to protect the pension insurance fund against further losses."

The Ground Employees' Retirement Plan has $1.2 billion in assets to cover $4.1 billion in benefit promises. Of the $2.9 billion shortfall, the PBGC will guarantee payment of an estimated $2.1 billion in benefits. The pension plan ends as of March 11, 2005.

"The decision to end a pension plan is never an easy one," said Belt. "But we must do everything we can to preserve our ability to pay benefits to the more than 1 million Americans who depend on us for their pension benefits. This is especially true in light of the program's current deficit."

Retirees in the United Airlines Ground Employees' Retirement Plan will continue to receive their monthly benefit checks without interruption, and other workers will receive their pension when eligible to retire. Under federal pension law, the maximum guaranteed pension at age 65 for participants in plans that terminate in 2005 is $45,613 per year. The maximum guaranteed amount is lower for those who retire earlier or elect survivor benefits. In addition, certain early retirement subsidies and benefit increases made within the past five years may not be fully guaranteed.

Until the PBGC becomes trustee, the pension plan remains ongoing under the sponsorship of United Airlines. Workers and retirees with questions may consult the PBGC Web site, www.pbgc.gov or call toll-free at 1-800-400-7242. United Airlines retirees who draw a benefit from the PBGC may be eligible for the federal Health Coverage Tax Credit. Further information may be found on the PBGC Web site at www.pbgc.gov/trade_adjustment_act_FAQ.htm.

The PBGC is a federal corporation created under the Employee Retirement Income Security Act of 1974. It currently guarantees payment of basic pension benefits earned by 44 million American workers and retirees participating in over 31,000 private-sector defined benefit pension plans. The agency receives no funds from general tax revenues. Operations are financed largely by insurance premiums paid by companies that sponsor pension plans and by investment returns.

Ask Senator Feinstein to save our courts

The fight to save our courts is about to really heat up. Bush just resubmitted 20 nominees to the U.S. Courts of Appeals that the Democrats fought four years to block. These 20 judges were rejected, while 204 were approved, because they have consistently sacrificed the rights of ordinary Americans to appease powerful special interests and extreme right-wing ideology. They must not be given lifetime appointments on the federal bench.

The Democrats can block them again, but only if they stand united. As a senior Democrat on the all-important Senate Judiciary Committee, Diane Feinstein can either embolden the Democratic resistance, or splinter it. That's why we need to call on her today for the leadership this issue demands.

The fight to save our courts only begins with these 20 nominees. Dick Cheney and Republican Majority Leader Bill Frist are now threatening to eliminate the filibuster. The filibuster is a Senate rule that allows 40 or more senators to force further debate before controversial votes -- and minority parties have used it to keep extremists from all sides off the courts for centuries.

It would require a two-thirds vote of the Senate to actually change the filibuster rule, and they know they don't have that much support. So instead, Cheney is planning to use his power as president of the Senate to simply declare the filibuster rule null and void. If Frist can get just 50 senators to support Cheney's ruling, the right to filibuster judges will be gone. It's a power grab so outrageous and unprecedented that even the Republicans call it the "nuclear option."

This all leads up to the next vacancy on the Supreme Court. Without the right to filibuster, there is no reason for Bush to nominate justices acceptable to both parties, and Democrats will be powerless to stop even the most dangerous nominees. With as many as 3 Supreme Court vacancies likely to come up in the next 4 years, the "nuclear option" is Bush's big push to lock in his hard-right, corporate friendly ideology for decades to come.

As this all unfolds, it's critical to get the calls in early -- even before the headlines hit. We can block Bush's 20 repeat nominees, and we can stop Cheney's "nuclear option" if at least 50 Senators oppose it. The first step is ensuring Democratic unity and vocal leadership from key senators like yours.

The 20 nominees Bush has resubmitted were rejected because of their extreme positions in favor of corporate interests and against civil rights, the environment, civil liberties, and the concerns of ordinary Americans. Here's a brief summary of just the first four to be considered.

William Myers III has never been a judge and spent most of his career as a lobbyist for the cattle and mining industry.[1] He has written that all habitat conservation laws are unconstitutional because they interfere with potential profit.[2] In 2001, Bush appointed him as the chief lawyer for the Department of the Interior. In that role he continued as a champion of corporate interests, setting his agenda in meetings with former employers he promised not to speak with, and even illegally giving away sacred Native American land to be strip mined.[3]

Terrence Boyle was a legal aide to Jesse Helms. As a judge, his signature decisions have attempted to circumvent federal laws barring employment discrimination by race, gender, and disability.[4] His rulings have been overturned a staggering 120 times by the conservative 4th Circuit Court of Appeals, either due to gross errors in judgment or simple incompetence.[5]

William Pryor Jr. served as Attorney General of Alabama, where he took money from Phillip Morris, fought against the anti-tobacco lawsuit until it was almost over, and cost the people of Alabama billions in settlement money for their healthcare system as a result.[6] He called Roe v. Wade "the worst abomination of constitutional law in our history," and has consistently argued against the federal protections for the civil rights of minorities, lesbian and gay couples, women, and the disabled.[7]

William Haynes III served as the chief legal council for the Defense Department, where he championed the outrageous legal theories that led to the torture at Abu Ghraib and Guantanamo Bay. Haynes also developed the "enemy combatant" doctrine, which allows for United States citizens to be detained without trial, due process, or access to a lawyer -- forever -- at the sole discretion of the president.[8]

If Democratic resolve falters, dozens of nominees like these will be granted lifetime appointments to the federal courts. And if Cheney and Frist "go nuclear" and take away the filibuster -- paving the way for an even more radical Supreme Court nominee -- there's no telling how bad things could get. We must not let that happen.

Bush's U.N. Ambassador: "There's no such thing as the U.N."

It's a little like nominating a felon to be police chief. Yesterday, President Bush nominated John Bolton, one of the most active opponents of U.S. multilateralism and diplomacy, to be ambassador to the U.N. But Bolton doesn't believe in international law, or in the U.N. In 2000, Bolton said, "If I were doing the Security Council today, I'd have one permanent member [the United States] because that's the real reflection of the distribution of power in the world." And he's gone on record saying that all international laws are invalid, meaningless attempts to constrict American power.

The whole idea of the U.N., of course, is that it's a place for the world community to work together on the problems that face us all. And at a time when we need other nations' goodwill and cooperation to deal with the mess in Iraq and to fight al Qaeda, confirming an inflammatory unilateralist like John Bolton as our ambassador to the rest of the world is a terrible idea. Even Republicans on the Foreign Relations committee in the Senate are nervous--according to the New York Times, Senator Lugar, who chairs the committee, advised Secretary of State Rice not to nominate Bolton.

If all the Democrats and one Republican on the Senate's Foreign Relations committee vote against Bolton's nomination, it'll stop there. But the committee will vote soon, and your Senator alone could make the difference. Please take a moment to call Senator Boxer at the number below today and ask her to oppose the nomination of John Bolton as U.N. Ambassador.

Bolton's take on foreign policy is so far out of the mainstream, he even makes Fox News' Bill O'Reilly look pretty good. Here's an excerpt from their 1999 conversation on "The O'Reilly Factor":

O'REILLY: And I find it difficult to stand by and watch another Cambodia, another Rwanda, unfold. And I believe the United States has a responsibility here.

BOLTON: Let me ask you this, Mr. O'Reilly. How many dead Americans is it worth to you to stop the brutality?

O'REILLY: I don't think I would quantify that because...

BOLTON: I think you have to quantify it. I think if you don't answer that question...

O'REILLY: ... I think if you're going to be a superpower...

BOLTON: ... you're ducking the key point that the commander in chief has to decide upon before putting American troops into a combat situation. We are now at war with Serbia. And the president has to be able to justify to himself and to the American people that Americans are about to die, or may well die, for a certain specific American interest.
