Mercury in Fish

In America one-in-six children born every year have been exposed to mercury levels so high that they are potentially at risk for learning disabilities and motor skill impairment and short-term memory loss. That type of mercury exposure is caused by eating certain kinds of fish, which contain high levels of the toxin from both natural and man-made sources such as emissions from coal-fired power plants. One government analysis shows that 630,000 children each year are exposed to potentially unsafe mercury levels in the womb. If the government and its scientists know about the mercury problem, why do so many people continue to be poisoned?

Over recent years NOW has examined how the influence of the tuna industry on the FDA may be putting Americans and their children at risk for mercury poisoning. Tuna, widely known for its health benefits, is one of the most popular foods on grocery store shelves. And, in 2000, FDA draft advisories presented to focus groups warned women not to eat a lot of canned tuna during pregnancy because it contains levels of mercury that can harm developing fetuses and nursing babies. In March 2004, the FDA and the EPA issued the first ever joint advisory on this topic, What You Need to Know About Mercury in Fish and Shellfish.

The State of California has gone a step further. In 2003 the California Attorney General's office filed suit to force supermarkets, restaurants and tuna companies to warn customers that tuna (fresh, frozen and canned), swordfish and shark sold in their markets contain mercury. The suit was based on the state's Proposition 65 which requires consumer warnings for substances on a toxics list. The state also provided special warnings advising women and children to "Limit their consumption of other fish, including tuna." And they further advised that "tuna steaks and canned albacore have higher levels of mercury than canned light."

Debating High-Speed Internet Access

The information revolution is making high-speed Internet access an essential element of success in America, but there's a growing divide between the techno-haves and have-nots that's keeping some poorer neighborhoods, schools, and businesses in the digital dark. In "The Philadelphia Experiment," NOW goes inside the battle for high-speed Internet in two communities — Philadelphia, Pennsylvania and Scottsburg, Indiana — where local governments want to build their own systems to provide affordable access to underserved neighborhoods, but are being challenged by the telecom giants that want to maintain their dominance in local markets.

Philadelphia Mayor John F. Street's plan to bring his city into the wireless business has engendered the most debate. In part, this is because previous municipal experiments in providing broadband service have been on a much smaller scale. The plan includes the installation of 4,000 wireless antennas on city lampposts to create an extensive broadband network. The mayor says that his plan will provide an essential service to the citizens of Philadelphia at a more affordable price than now offered by Telecommunications and cable companies — with prices ranging from $15 to $25 a month and lower prices for low-income residents.

Critics of the plan also doubt that the system will stay within it's projected $10 million start-up budget and won't be able to be self-sustaining. They also worry that the responsibilities and costs of maintaining such a system will soon prove too much for the city and quality of service to the public will decline. But a major point of debate is of a more philosophical nature. Telecom and cable companies counter that the government should not be allowed to have an advantage over private enterprise, especially one funded by tax dollars. Proponents counter that the digital airwaves are in essence a public entity and access to them should be a matter of public responsibility.

In several states telecommunications and cable companies have begun lobbying efforts in favor of restricting local governments from starting networks like that proposed in Philadelphia. Last year Pennsylvania Governor Ed Rendell signed a measure which gave partial victory to the industry. The new legislation requires that cities give the local phone company first dibs on creating a broadband network. If they companies act within 14 months of a proposed municipal plan, the cities must give way to private industry. The new measure does not affect Philadelphia where the debate continues.

This week NOW well tell you what your Gov. this week to you if you run out of money due to unpaid Medical bills, IE your bankruptcy law have been lessened and most of the people today that file for bankruptcy do so because of Medical problems and 90% of these people have medical coverage.

This week in California the Govenor stated he want to be able to take away assets from people after they've died if they were on aid from the state.

WEll, we put them in office and not just once but twice? Does anybody care? Is anybody there. Does anybody see what I see?

OH! And by the way, SS? If the Fed. will just pay BACK the money they took from SS we'll be just fine. Remember we had a shot at it a couple of yrs. back and your Gov. didn't do it. Ya want know why? Cause they know they didn't have to. And they didn't and now there out there telling how we most pay to fix it. And your going to take, airn't you? Yeah, you are cause you won't do anything about what they're going to you. And they know that afew yrs. ago and they're right, airn't they.

Does anybody care? Is anybody there? Does anybody see what I see?

Please, remember that these people in Gov. are "pulic servants" and as such they, by law, own you who their efferts to you "The Pulic" not the Corp. World. Go tell them what you want of them and if they don't do it, VOTE them OUT of office ( IE Fire'em). And with this roll back of your bankrupty laws they inproved the corp. world at your loss. You can now fire'em. They have broken the law.

Revolt! It won't need to be much of one, you saw that the blacks of this country did to get what they should have had back in 1776, if not for the south. Now joint your black brothers and sister and just do the same things again only this time for your own worth as the middle class is just about gone. Just in case you didn't know. And it's been the Middle class that has made the differance between us and the rest of the world. While your Public Servants are telling you that the US is the most powerful county in the world they're pooring it to death. And dooming it down at the same time. Moneies are going from your pocket to the biggest of the Corp. World all in the name of "your safety" and our borders have never been SO open. Letting in the doomest come in from the south and the deadliest come in thuogh the north.

Does anybody care? Is anybody there? Does anybody see what I see?

And that just part of what's going on that, unless your reading this and others like it your don't even know of. And the papers won't say a thing as it's not in their intrest any more. And like I said earlier, there braking the law to do it and if your quick enough, cause they're changing the laws just a little slower than they are "doing it to ya", you can still use the law to "get them".

What is an "OLD GEEZERS"?

Health Groups List Fish Posing Mercury Risks

With recent revelations that the Environmental Protection Agency disregarded two key health studies in drafting its controversial new rule for reducing mercury emissions, the battle over mercury regulations continues to make headlines.

While health advocates continue to press for stronger standards, the Republican staff of the House Resources Committee issued a report earlier this month asserting that the dangers of mercury are overblown. Environmental and public health groups are "crying wolf," said Committee Chair Richard Pombo (R-CA). [1]

Lost amidst the coverage of the year-long political battle is more definitive guidance for the average citizen about what she/he can do to minimize mercury's health dangers. All experts agree that the primary means of mercury exposure is through eating fish. The question many are asking is: what are the fish that pose the greatest health risks?

Last year the Food and Drug Administration (FDA), began recommending that women and children limits consumption of albacore tuna, which comprises 30% of all the canned tuna sold in the U.S. The Mercury Policy Project says that children eat twice as much tuna as any other fish. Women of child-bearing age are also frequent consumers of canned tuna. [2]

The FDA also advised caution regarding shark, swordfish, king mackerel and tilefish. [3]

Health advocacy nonprofits such as the Environmental Working Group (EWG) have issued reports stating that FDA has underestimated the danger. "If women follow the FDA's advice and eat one can of albacore tuna a week," said an EWG report, "hundreds of thousands more babies will be exposed to mercury." [4]

Along with organizations such as NRDC, Physicians for Social Responsibility, the Association of Reproductive Health Professionals, the Endangered Fish Alliance, Organic Consumers Association, and the Green Guide, EWG has compiled lists of fish that are least safe to eat, as well as those that pose little or no health risk.

For example, EWG's list of fish to be avoided by pregnant women includes shark, swordfish, king mackerel, tilefish, tuna steaks, canned tuna, sea bass, Gulf Coast oysters, marlin, halibut, pike, walleye, white croaker and largemouth bass.

In most cases the rule of thumb is to avoid the largest of the deep cold water ocean fish. They are at the top of the food chain, eating huge quantities of smaller fish that swim nearer the surface, which becomes polluted as mercury emissions from power plants drift down into the water.

The NRDC list calls for at-risk populations to avoid grouper, marlin, orange roughy, swordfish, tilefish, shark and king mackerel. A second-tier category lists other fish that are high in mercury and should be eaten in 6-ounce servings no more than three times per month.

That list includes saltwater bass, croaker, halibut, tuna (canned white albacore), tuna (fresh, bluefish, ahi), sea trout, bluefish and lobster (American, Maine). [5]

Despite the House Resources Committee charge that mercury risks are exaggerated by the public health community, impartial scientific and medical experts are in overwhelming agreement that mercury exposure is a serious health threat.

Prenatal and infant exposure can cause mental retardation, cerebral palsy, deafness, blindness, reduced attention span, and delayed onset of the ability to talk and walk. The EPA estimates that 630,000 children per year are born with unsafe levels of mercury.

In adults, mercury poisoning can adversely affect fertility and blood pressure regulation. It can also lead to memory loss, tremors, vision loss and numbness of the fingers and toes. A number of studies also link mercury exposure to heart disease.

Radical Republicans are reaching for absolute power to appoint Supreme Court justices who favor corporate and extreme-right interests over the rest of us - and we only have a few weeks to stop them.

Their plan is to throw out 200 years of checks and balances in the Senate, by silencing the minority party for the first time in American history. It's a maneuver so outrageous that even Republicans call it the "nuclear option." It will take 51 senators to defeat them, and the vote is probably less than a month away.

The Republican leadership is working overtime to keep their plan out of sight, because they know most Americans oppose their bid for absolute power. To fight back, we need to expose them on the nation's editorial pages, and demand that our senators stand up against one party rule.

The next week is critical. All our senators will be home and paying close attention to the local press. Moderate Republican and Democratic senators will be looking this week to see where their constituents stand - and letters to the editor are one of the most powerful ways to show them that we are ready to fight.

The "nuclear option" calls for Dick Cheney to use a parliamentary trick to overturn the 200-year-old right to filibuster judicial nominations. A filibuster is simply the right of a group of at least 41 concerned senators to extend debate and delay controversial votes. If Senate Majority Leader Bill Frist can twist enough arms to get 51 votes in support of Cheney's ruling, the minority party will be completely silenced for the first time ever.

The Internet is often a lawless place. Everyone knows that there are many tricks and traps lurking on the Internet, just waiting to prey on unsuspecting and innocent users. Some of these traps will trash your computer while others will turn your PC into a zombie that will broadcast messages at the virus writer's command. Still other traps steal people's identity and in addition to stealing their money and good name, victims have to endure an incredible amount of hassle. Then there's spyware. The list of annoyances and downright criminal activities seem endless.

Law enforcement is just getting around to cleaning up the internet.

To make the Internet a safer place both legislators and law enforcement are now focusing on the Internet. In the crossfire that's taking place there are many ideas that are being offered up. Some of them are good and some are not. One bad decision that was recently forced upon the Internet community (without hearings -- more on this later) was to eliminate private domain name registrations for .US domain names. The purpose of this article is to explain why private domain name registrations are a good thing, and how they actually make the internet a safer place.

First, why the public WHOIS database is important.

The information in (or associated with) the WHOIS database is important to law enforcement, intellectual property and other attorneys, who use this data to locate domain name owners for the purpose of enforcing laws or addressing grievances. In certain cases, however, the information in the WHOIS database is not accurate. This is where the problem caused by anonymity rears its ugly head.

The problems with the public WHOIS database.

There are two big problems with the WHOIS database. One is that often times the information within the database is inaccurate. Inaccurate information happens mostly because some registrants who want to achieve anonymity -- for a myriad of reasons, some of which are despicable -- provide false information to begin with. The second problem with the WHOIS database is that there are many law abiding citizens who also, for a myriad of reasons, want their personal information not made available to the public.

Making the public WHOIS database 100% accurate has proven elusive.

Various government agencies, intellectual property organizations, attorneys, and others have long wrestled with how to improve the accuracy of information in the WHOIS database. To date, they have not been able to find a way to guarantee or even improve the accuracy of this information.

It is now illegal to provide false information when registering a domain name.

Last year, there was a brief attempt to make registrars responsible for the accuracy of the Whois database. Fortunately, that legislation failed. What did become law was a new, stiff penalty (7 years) for providing false WHOIS information. While this looming jail time might have some sway over US-based crooks, it will do little to get accurate information from those who live overseas.

Private domain registrations have the most accurate registrant information.

The most accurate domain registration information is that associated with private domain name registrations. The reason this information is accurate, is because people pay to make it private. If it wasn't accurate, if the information was false to begin with, the registrant would simply leave it as is. There would be no reason to incur the added, small expense of a private registration. Most law enforcement agencies and other intellectual property oriented organizations understand this fact, and support private registrations. In fact, every intellectual property organization and law enforcement representative that has contacted us regarding our private registration service has supported the service because of the accuracy of the underlying data compared to the general inaccuracy in the WHOIS database as a whole.

The reason law enforcement supports private registrations is that in addition to the information being the most accurate associated with domain name registrations, there's an added bonus. That bonus is accountability. Law enforcement knows that if it has an issue with a private domain name registration, that it will not only be able to find the actual registrant, but that the registrant will be accountable for whatever the issue happens to be. This is not the case with public WHOIS registrations, where anonymity is achieved by providing bogus information. There's often no way to track down a registrant who provided false information when registering their domain name.

Making the entire WHOIS private is not a good idea.

One last comment concerning the importance of private domain name registrations: There has also been talk about making the entire WHOIS private. This would not be a step in the right direction. There are several reasons why it wouldn't work. First, there are significant, additional costs for the registrar to manage private registrations. These costs include the daily processing of subpoenas, requests from law enforcement and complaints from companies and individuals. To this, add the cost to litigate lawsuits that are filed almost on a daily basis. These lawsuits typically involve copyright and/or slander complaints, and usually name the registrar as well as the domain holder. Presently, this cost is paid for by those who want private registrations. If all registrations are made private, the cost would be added to all registrations.

The other reason why making the entire WHOIS private is not a good idea, is that it would place an added burden on everyone (i.e., law enforcement, intellectual property and other attorneys, etc.) who need to get at the WHOIS information. Today, because of our public WHOIS, it is easy to determine if information associated with a public registration is valid or not. If the entire WHOIS would be made private, there would be a number of added and unnecessary steps to make this same determination. So you see, it's much better to keep the WHOIS public but allow those who want private domain name registrations the ability to purchase them.

It's important to understand the difference between privacy and anonymity.

This brings me to the issue of privacy versus anonymity. Not long ago, I was discussing this issue with David Lawrence, one of the most intelligent persons I know who just always seems to "get it." After I finished describing to him that the National Telecommunications and Information Administration (NTIA) ruled, without hearings of any kind, that private domain name registrations for .US domains will no longer be allowed, David commented that the issue is really one of privacy versus anonymity. He explained that privacy should be allowed, because with privacy comes accountability. Thus, Americans and others who enjoy privacy are law abiding citizens, and have no reason to fear being accountable for their use of privacy.

The NTIA edict makes the Internet a worse, and less safe, place.

What the NTIA is concerned about, and what their recent edict does not achieve, is the reduction of anonymity. In fact, it does just the opposite, because it now encourages those who want privacy for .US domain names to provide false information -- thus achieving anonymity.

Criminals seek anonymity, not privacy.

It's been my experience that those who are the criminals of the Internet, and who are engaged in spamming, phishing, pharming, identity theft, etc., take whatever actions they can think of to make themselves as anonymous as possible. Thus, when law enforcement and others attempt to track these crooks down, it's either very difficult or impossible. This is the problem with anonymity -- there is no accountability. Often, those who seek anonymity typically do so because they are up to no good, and want to be sure that they don't have to answer for whatever evil they are perpetrating.

Registrants who purchase private registrations have no problem with accountability.

In contract, those who seek privacy are fine receiving it with accountability. Law abiding citizens have no problem being held accountable for their actions. This is because, well, they are law abiding. So when people pay for private domain registrations they typically send three messages. The first message is that they are law abiding citizens; the second message is that they are willing to be held accountable for their actions; and the third and most important message, is that the registration information they are providing is valid.

Law abiding Americans are entitled to privacy.

The overriding message of this article is that the absolute, most accurate information associated with domain name registrations, is the information provided with private domain name registrations. The NTIA's decision to eliminate private .US registrations accomplishes exactly the opposite of what it wants to achieve -- better information that is more readily available. Instead, what the NTIA has done (besides denying law abiding Americans their Constitutional right to privacy) is to increase the anonymity in an already anonymous, wild, and often lawless Internet. And that is in nobody's best interests.

The Schwarzenegger administration violated state law by producing video news releases that resemble television news reports to promote the governor's push to change worker regulations, three unions claim in a lawsuit filed Monday.

The videos promoting Gov. Arnold Schwarzenegger's push to repeal nurse-staffing ratios and alter meal break guarantees for hourly employees violate the state's law against using government resources to produce propaganda to advance its policies, representatives of the unions said Tuesday.

The state's Labor and Workforce Development Agency, which is considering whether to relax the regulations that require hourly employees to take a meal break during an eight-hour shift, produced the videos.

They include suggested introductions by a news anchor and interviews with supporters of the governor's policies. But they do not mention opposition to Schwarzenegger's proposals and give no indication in the parts designed to be shown on television that they were produced by the state.

That suggests the state has already taken a position on the rule change, said Art Pulaski, executive secretary-treasurer with the California Labor Federation, which makes a mockery of hearings to solicit the public's opinion.

"It's a violation of the spirit of rulemaking and lawmaking to take a predetermined position a day before public hearings on the issue are to start," Pulaski said.

The suit was filed Monday in Sacramento Superior Court by the California Labor Federation, the California Nurses Association and a division of the Service Employees International Union.

Rick Rice, the undersecretary of the California Labor and Workforce Development Agency, said he hadn't been served a copy of the lawsuit and couldn't comment.

Schwarzenegger's office defended the use of the video news releases and said they would continue to use them to illustrate issues and policies.

"There's nothing new about doing video news releases. It's done in the private sector," said Schwarzenegger spokeswoman Margita Thompson.

"They are free to file their lawsuits," she said. "We are certain we are on solid legal ground."

But the unions' lawsuit claims state law specifically prohibits using public funds to "'take sides' or give unfair advantage to one of several competing factions in a partisan or political process."

The state-funded videos were deceptive because their purpose was to persuade the public to support Schwarzenegger's proposals, said Rose Ann De Moro, executive director of the California Nurses Association.

"This guy is fluff," DeMor said. "He's got these fake newscasters trying to convince people to buy into his corporate agenda." De Moro said.

The 60,000-member CNA successfully sued to overturn Schwarznegger's repeal of nurse-to-patient staffing ratios that were signed by then-Gov. Gray Davis in 2003 after four years of hearings and negotiations. A judge ruled earlier this month that Schwarzenegger illegally delayed the new regulations, which require California hospitals to raise staffing ratios to one nurse for each five patients.

The administration estimates the new ratios would require 2,360 additional nurses and vowed to appeal the ruling.

On Tuesday, Assembly Speaker Fabian Nunez, D-Los Angeles, asked the Federal Communications Commission to investigate if television stations broke any laws if they aired the "mock news videos ... without disclosing that the state government was the source of the information."

Besides not including opposing views, Nunez said in his letter to the FCC, "there was no audio or video disclaimer in the piece itself that indicated its origin."

Last week, the Legislature's attorneys opined that the administration didn't have the authority to put out the meal break video.

State Controller Steve Westly said he agreed with the opinion written by Deputy Legislative Counsel Cecilia Moddelmog and would audit how much was spent to produce videos and track how effective they were.
