BERGER INVESTIGATION REVEALS HYPOCRISY

It has been a longstanding policy of the Justice
Department not to comment on ongoing investigations.
For example, when Deputy Attorney General James
Comey, Jr. was asked to comment on the Justice
Department investigation into the outing of Joe Wilson's
wife as an undercover CIA operative, he said, "I
can't tell you about the details of any ongoing
criminal investigation because our goal is to make sure
... anyone who might not be charged with a crime
isn't unfairly smeared."[1] Now, in an effort to
undermine the credibility of former National Security
Advisor Sandy Berger, the Justice Department has
abruptly changed its policy.

Initially, career prosecutors handling the Berger
investigation advised employees at the National
Archives of their policy: Don't discuss the details of
an ongoing case. But according to a letter by Rep.
Henry Waxman (D-CA), on July 27, Republican staff
members of the House Government Oversight Committee
"contacted the Assistant Attorney General in the
Office of Legislative Affairs and asked him to
intervene to overrule the judgment of the career
prosecutors."[2] Days later, the Justice Department
reversed their policy and advised archive employees they
were "in no way constrained" from discussing any
details of the Berger case.

In short order, Republican Chairman of the
Oversight Committee, Rep. Tom Davis (R-VA) has requested
all written or electronic communications about Berger
from the archive staff. Members of the staff have
also been asked to submit to interviews by the
committee.

Berger admits he inadvertently removed some
photocopies of classified documents from a government
reading room. But Davis has decided to launch his
expedition despite public statements by the 9/11
Commission General Counsel Daniel Marcus that Berger did
not withhold any original material from the
Commission.[3]

DESPITE PROMISES, BUSH REFUSES TO PROSECUTE LEAKS

President Bush has promised to prosecute those who
leak sensitive classified information, saying, "We
can't have leaks of classified information."[1]
Attorney General John Ashcroft said, "leaks of
classified information do substantial damage to the
security interests of the nation."[2] Ashcroft promised
swift prosecution of leaks, saying, "Until those
who, without authority, reveal classified information
are deterred by the real prospect of productive
investigations and strict application of appropriate
penalties, they will have no reason to stop their
harmful actions."[3] But according to a new report,
the Bush administration is refusing to prosecute a
top Republican who leaked classified information.

As the Washington Post reports, "Federal
investigators concluded that Sen. Richard C. Shelby (R-Ala.)
divulged classified intercepted messages to the
media when he was on the Senate Select Committee on
Intelligence." The Post also reports, "Though the FBI
and the U.S. attorney's office pursued the case,
and a grand jury was empaneled ... the Justice
Department decided to forgo a criminal prosecution."[4]

Also, AP reports Rep. Katherine Harris (R-FL)
apparently divulged classified information about how
many terrorist attacks have been thwarted, and about a
terrorist threat on an Indiana community.[5] Harris
is the woman who as Florida Secretary of State
helped deliver the election to President Bush. There is
no word on whether the Bush Justice Department will
investigate Harris.

Dissenting Scientist Fired by Administration's Fish and Wildlife Service

Last May BushGreenwatch reported that a 17-year veteran of the U.S. Fish and Wildlife Service (FWS) had filed a legal complaint against the agency, charging that agency officials deliberately used flawed scientific data in setting policy for protecting the Florida panther, an endangered species with only 60-80 animals remaining in the wild. [1]

Now Fish and Wildlife officials have notified the agency employee, biologist Andrew Eller, that they intend to fire him for "unacceptable" performance. Eller has spent the last 10 years working in the Florida panther recovery program.

The move follows the firing on July 9 of Theresa Chambers, chief of the U.S. Park Police, after she publicly stated that the government response to the 9/11 terrorist attacks had stretched her staff's capacities to the limits, and that she needed more resources. Eller's dismissal reinforces the growing perception that the Bush Administration is utterly intolerant of internal dissent.

Eller's legal challenge, which was filed jointly with the advocacy group Public Employees for Environmental Responsibility (PEER), alleges that studies used by FWS inaccurately inflate the panthers' population in South Florida, thereby minimizing the amount of habitat the animals need to survive.

Specifically, the agency assumes in its population estimates that all known panthers are breeding adults, and that the population includes no juveniles or aged animals. The agency further minimized habitat needs by considering only daytime habitat, when the panthers are at rest, and not nighttime habitat needs, when they are active. [2]

On July 7, the Fish and Wildlife Service replied to the Eller's challenge and admitted using flawed data, stating:

"We acknowledge that despite being published in peer-reviewed scientific journals, some of the information you are challenging has, over time, been determined to have limitations..."

Nevertheless, FWS asserted that it would continue using the inaccurate data until 2006, by which time several huge developments in Southwest Florida, within shrinking panther habitat, may be approved. According to PEER, Fish and Wildlife is under enormous political pressure to approve the developments. [3]

Commenting on Eller's firing, PEER executive director Jeff Ruch told BushGreenwatch, "When it comes to intimidating its own scientists, the Fish and Wildlife Service is about as subtle as a Mack truck. The Fish and Wildlife Service is signaling that under the Bush administration scientists who wonÂ’t play ball will be blackballed." [4]

Under government rules, Eller has 30 days to respond to his proposed dismissal. If FWS proceeds with its plans to remove him, he can challenge the action before the Merit Systems Protection Board, the court of the federal civil service.

REPORT PROVES BUSH KNEW HE WAS LYING ABOUT IRAQ

Earlier this week, President Bush claimed "we all
thought we would find
stockpiles of weapons"[1] in Iraq, and claimed that
he had no inkling that
his pre-war claims about the Iraqi threat were
weak. But as a major new
story released today shows, the President and other
top administration
officials were repeatedly warned before the
invasion that its case for war
was weak.

analyzes declassified
government documents and intelligence reports given
to the White House
before the war. These documents either warned the
administration about its
WMD and Iraq-al Qaeda claims, or totally debunked
them. In some cases,
intelligence experts explicitly warned top
officials not to make the claims
they were making, and yet they were ignored. The
story wholly refutes
assertions by the White House and Republicans that
it was the intelligence
community to blame. In fact, as the data shows, the
White House deliberately
ignored intelligence to mislead America.

The rules and the good intentions of the men increased the possibility that we might take friendly casualties."

BUSH CRITICISM OF FRIVOLOUS LAWSUITS HYPOCRITICAL

President Bush has repeatedly criticized what he
calls a plague of frivolous lawsuits. In 2001, he
said, "It's really important that we not have our
system ladened down by unnecessary lawsuits."[1] More
recently he complained that "there's too many
lawsuits, a lot of them frivolous and junk lawsuits."[2]
Yet, as the historical record shows, it was George
W. Bush who in 1998 actually hired a trial lawyer
and filed a lawsuit against a rental car company
that legal experts called "unnecessary."

On November 2, 2000, the New York Daily News
reported that Bush sued Enterprise Rent-a-Car in Austin
over a fender bender involving his daughter, even
though no one was hurt, and insurance would have
covered the collision.[3] Bush "also tried to sue the
woman who was driving the rental car but was unable
to serve her with papers." Lawyers familiar with
Texas insurance law "said such a suit would normally
be unnecessary." One lawyer involved in the case
said Bush sued because he "had paid for the repairs
out of his own pocket" and that Bush pursued legal
action even though the parties "exhaustively tried
to resolve it short of a lawsuit."

Bush Administration Punts on Cutting Toxic Mercury Emissions

Contamination of ocean fish such as tuna, with toxic mercury from coal-fired power plants, has received wide publicity in recent months. But now a new report by the U.S. Public Research Group Education Fund (PIRG) shows that fish in America's lakes, rivers, and streams are also contaminated with mercury, putting at risk sport and subsistence fishermen and their families.


Mercury is a powerful neurotoxin that can cause learning disabilities, developmental delays, and problems with fine motor coordination. Mercury can also affect multiple organ systems, including the heart, immune system, and the nervous system over a lifetime.


PIRG analyzed data collected by the Environmental Protection Agency (EPA), which between 1999 and 2001 tested fish for toxic mercury in a representative sample of 260 lakes and reservoirs in the U.S. EPA's testing revealed that every fish sample taken was contaminated with mercury, and most of the samples were contained at levels that could pose a risk to public health. Fifty-five percent of the fish samples were contaminated at levels exceeding EPA's "safe" limit for women of average weight who eat fish twice a week. Seventy-six percent of the samples exceeded the safe limit for children under three who eat fish twice a week.


Most heavily contaminated were predator fish like bass, walleye, lake trout, and Northern pike, with 80 percent of predator fish samples exceeding EPA's safe limit for women. In 18 states, 100 percent of the predator samples exceeded this limit. [2]


President Bush's plan to reduce toxic mercury emissions from power plants would utterly fail to protect public health for the next 20 years. Unveiled in January, the President's proposal would put off even modest reductions until 2025, even though the Clean Air Act calls for maximum possible reductions by 2008. [3]


In the 2004 Presidential election, the nation's electric utilities raised $447,000 in PAC and individual campaign contributions for George W. Bush, compared to $65,000 for Democratic candidate Al Gore. In fact, President Bush raised more money from electric utilities in two years than any other candidate for federal office raised cumulatively over the past 10 years. [4]

I Am Your Worst Nightmare. I am a BAD American. I am George Carlin.

I believe the money I make belongs to me and my family, not some mid level governmental functionary, be it Democratic or Republican!

I think owning a gun doesn't make you a killer, it makes you a smart American.

I think being a minority does not make you noble or victimized, and does not entitle you to anything.

I believe that if you are selling me a Big Mac, try to do it in English.

I think fireworks should be legal on the 4th of July.

I think that being a student doesn't give you any more enlightenment than working at Blockbuster. In fact, if your parents are footing the bill to put your pansy ass through 4 years plus of college, you haven't begun to be enlightened.

I believe everyone has a right to pray to his or her God when and where they want to.

My heroes are John Wayne, Babe Ruth, Roy Rogers, and whoever canceled Jerry Springer.

I don't hate the rich. I don't pity the poor.

I know wrestling is fake and I don't waste my time arguing about it.

I've never owned a slave, or was a slave, I didn't wander forty years In the desert after getting chased out of Egypt. I haven't burned any witches or been persecuted by the Turks and neither have you! So, shut the hell up already.

I want to know which church is it exactly where the Reverend Jesse Jackson practices, where he gets his money, and why he is always part of the problem and not the solution. Can I get an AMEN on that one?

I think the cops have every right to shoot your sorry ass if you're running from them.

I also think they have the right to pull you over if you're breaking the law, regardless of what color you are.

I think if you are too stupid to know how a ballot works, I don't want you deciding who should be running the most powerful nation in the world for the next four years.

If this makes me a BAD American, then yes, I'm a BAD American.

BUSH MISLEADS ON THE STATE OF THE ECONOMY

In his radio address Saturday President Bush
declared, "this week we
received encouraging reports that show our economy
is gaining strength."[1]
The actual reports, however, suggest otherwise.

A new GDP report by the Commerce Department
revealed that the "economy grew
at a slow-paced 3 percent annual rate in the second
quarter, renewing
concerns about a weak overall recovery and the
potential for mediocre future
job growth." The figure was "the slowest growth
rate since the beginning of
last year," down 1.5 percent from the previous
quarter. Growth in consumer
spending also plummeted, falling to just 1 percent
- down three points from
the previous quarter.[2]

On Friday the White House estimated that "the
budget deficit would reach
$445 billion in this fiscal year, by far the
largest shortfall ever."[3] The
administration claims that this figure is an
improvement, but in February
2003 the White House estimated that the deficit for
2004 would be just over
$300 billion.[4]
