FOR IMMEDIATE RELEASE
March 11, 2005 PBGC Public Affairs, 202-326-4040

PBGC Will Assume Ground Employee Pension Plan at UAL

WASHINGTON-The Pension Benefit Guaranty Corporation(or the US gov.) today announced it is moving to assume responsibility for the pensions of more than 36,000 active and retired ground employees of United Airlines.

"United's pension plan for its ground employees is only 30 percent funded, the company has missed $363 million in legally required contributions, and management has repeatedly stated its intention to terminate the plan," said Executive Director Bradley Belt. "This action was necessary at this time to protect the pension insurance fund against further losses."

The Ground Employees' Retirement Plan has $1.2 billion in assets to cover $4.1 billion in benefit promises. Of the $2.9 billion shortfall, the PBGC will guarantee payment of an estimated $2.1 billion in benefits. The pension plan ends as of March 11, 2005.

"The decision to end a pension plan is never an easy one," said Belt. "But we must do everything we can to preserve our ability to pay benefits to the more than 1 million Americans who depend on us for their pension benefits. This is especially true in light of the program's current deficit."

Retirees in the United Airlines Ground Employees' Retirement Plan will continue to receive their monthly benefit checks without interruption, and other workers will receive their pension when eligible to retire. Under federal pension law, the maximum guaranteed pension at age 65 for participants in plans that terminate in 2005 is $45,613 per year. The maximum guaranteed amount is lower for those who retire earlier or elect survivor benefits. In addition, certain early retirement subsidies and benefit increases made within the past five years may not be fully guaranteed.

Until the PBGC becomes trustee, the pension plan remains ongoing under the sponsorship of United Airlines. Workers and retirees with questions may consult the PBGC Web site, www.pbgc.gov or call toll-free at 1-800-400-7242. For TTY/TDD users, call the federal relay service toll-free at 1-800-877-8339 and ask for 800-400-7242.

United Airlines retirees who draw a benefit from the PBGC may be eligible for the federal Health Coverage Tax Credit. Further information may be found on the PBGC Web site at www.pbgc.gov/trade_adjustment_act_FAQ.htm.

The PBGC is a federal corporation created under the Employee Retirement Income Security Act of 1974. It currently guarantees payment of basic pension benefits earned by 44 million American workers and retirees participating in over 31,000 private-sector defined benefit pension plans. The agency receives no funds from general tax revenues. Operations are financed largely by insurance premiums paid by companies that sponsor pension plans and by investment returns.

Ask Senator Feinstein to save our courts

The fight to save our courts is about to really heat up. Bush just resubmitted 20 nominees to the U.S. Courts of Appeals that the Democrats fought four years to block. These 20 judges were rejected, while 204 were approved, because they have consistently sacrificed the rights of ordinary Americans to appease powerful special interests and extreme right-wing ideology. They must not be given lifetime appointments on the federal bench.

The Democrats can block them again, but only if they stand united. As a senior Democrat on the all-important Senate Judiciary Committee, Diane Feinstein can either embolden the Democratic resistance, or splinter it. That's why we need to call on her today for the leadership this issue demands.

Please call Senator Feinstein's office and ask her to strongly oppose ALL 20 of Bush's repeat judicial nominees to the United States Courts of Appeals, at:

(202) 224-3841

Then, let us know you called:
http://www.moveonpac.org/judicial/call/

The fight to save our courts only begins with these 20 nominees. Dick Cheney and Republican Majority Leader Bill Frist are now threatening to eliminate the filibuster. The filibuster is a Senate rule that allows 40 or more senators to force further debate before controversial votes -- and minority parties have used it to keep extremists from all sides off the courts for centuries.

It would require a two-thirds vote of the Senate to actually change the filibuster rule, and they know they don't have that much support. So instead, Cheney is planning to use his power as president of the Senate to simply declare the filibuster rule null and void. If Frist can get just 50 senators to support Cheney's ruling, the right to filibuster judges will be gone. It's a power grab so outrageous and unprecedented that even the Republicans call it the "nuclear option."

This all leads up to the next vacancy on the Supreme Court. Without the right to filibuster, there is no reason for Bush to nominate justices acceptable to both parties, and Democrats will be powerless to stop even the most dangerous nominees. With as many as 3 Supreme Court vacancies likely to come up in the next 4 years, the "nuclear option" is Bush's big push to lock in his hard-right, corporate friendly ideology for decades to come.

As this all unfolds, it's critical to get the calls in early -- even before the headlines hit. We can block Bush's 20 repeat nominees, and we can stop Cheney's "nuclear option" if at least 50 Senators oppose it. The first step is ensuring Democratic unity and vocal leadership from key senators like yours.

Please call Senator Feinstein today and ask her to oppose ALL of Bush's repeat nominees to the U.S. Courts of Appeals, and defeat the Republican "nuclear option" to eliminate the filibuster at:

(202) 224-3841

The 20 nominees Bush has resubmitted were rejected because of their extreme positions in favor of corporate interests and against civil rights, the environment, civil liberties, and the concerns of ordinary Americans. Here's a brief summary of just the first four to be considered.

William Myers III has never been a judge and spent most of his career as a lobbyist for the cattle and mining industry.[1] He has written that all habitat conservation laws are unconstitutional because they interfere with potential profit.[2] In 2001, Bush appointed him as the chief lawyer for the Department of the Interior. In that role he continued as a champion of corporate interests, setting his agenda in meetings with former employers he promised not to speak with, and even illegally giving away sacred Native American land to be strip mined.[3]

Terrence Boyle was a legal aide to Jesse Helms. As a judge, his signature decisions have attempted to circumvent federal laws barring employment discrimination by race, gender, and disability.[4] His rulings have been overturned a staggering 120 times by the conservative 4th Circuit Court of Appeals, either due to gross errors in judgment or simple incompetence.[5]

William Pryor Jr. served as Attorney General of Alabama, where he took money from Phillip Morris, fought against the anti-tobacco lawsuit until it was almost over, and cost the people of Alabama billions in settlement money for their healthcare system as a result.[6] He called Roe v. Wade "the worst abomination of constitutional law in our history," and has consistently argued against the federal protections for the civil rights of minorities, lesbian and gay couples, women, and the disabled.[7]

William Haynes III served as the chief legal council for the Defense Department, where he championed the outrageous legal theories that led to the torture at Abu Ghraib and Guantanamo Bay. Haynes also developed the "enemy combatant" doctrine, which allows for United States citizens to be detained without trial, due process, or access to a lawyer -- forever -- at the sole discretion of the president.[8]

If Democratic resolve falters, dozens of nominees like these will be granted lifetime appointments to the federal courts. And if Cheney and Frist "go nuclear" and take away the filibuster -- paving the way for an even more radical Supreme Court nominee -- there's no telling how bad things could get. We must not let that happen.

Please call Senator Feinstein's office at (202) 224-3841. Ask her to strongly oppose ALL 20 of Bush's repeat judicial nominees, and do everything she can to defeat the "nuclear option" at:

(202) 224-3841

Then, let us know you called:

Bush's U.N. Ambassador: "There's no such thing as the U.N."

It's a little like nominating a felon to be police chief. Yesterday, President Bush nominated John Bolton, one of the most active opponents of U.S. multilateralism and diplomacy, to be ambassador to the U.N. But Bolton doesn't believe in international law, or in the U.N. In 2000, Bolton said, "If I were doing the Security Council today, I'd have one permanent member [the United States] because that's the real reflection of the distribution of power in the world." And he's gone on record saying that all international laws are invalid, meaningless attempts to constrict American power.

The whole idea of the U.N., of course, is that it's a place for the world community to work together on the problems that face us all. And at a time when we need other nations' goodwill and cooperation to deal with the mess in Iraq and to fight al Qaeda, confirming an inflammatory unilateralist like John Bolton as our ambassador to the rest of the world is a terrible idea. Even Republicans on the Foreign Relations committee in the Senate are nervous--according to the New York Times, Senator Lugar, who chairs the committee, advised Secretary of State Rice not to nominate Bolton.

If all the Democrats and one Republican on the Senate's Foreign Relations committee vote against Bolton's nomination, it'll stop there. But the committee will vote soon, and your Senator alone could make the difference. Please take a moment to call Senator Boxer at the number below today and ask her to oppose the nomination of John Bolton as U.N. Ambassador.

Here's Senator Boxer's number:

Bolton's take on foreign policy is so far out of the mainstream, he even makes Fox News' Bill O'Reilly look pretty good. Here's an excerpt from their 1999 conversation on "The O'Reilly Factor":

O'REILLY: And I find it difficult to stand by and watch another Cambodia, another Rwanda, unfold. And I believe the United States has a responsibility here.

BOLTON: Let me ask you this, Mr. O'Reilly. How many dead Americans is it worth to you to stop the brutality?

O'REILLY: I don't think I would quantify that because...

BOLTON: I think you have to quantify it. I think if you don't answer that question...

O'REILLY: ... I think if you're going to be a superpower...

BOLTON: ... you're ducking the key point that the commander in chief has to decide upon before putting American troops into a combat situation. We are now at war with Serbia. And the president has to be able to justify to himself and to the American people that Americans are about to die, or may well die, for a certain specific American interest.

[edit]

BOLTON: I believe...

O'REILLY: ... I do not believe in standing by while people are slaughtered.

BOLTON: ... Our foreign policy should support American interests. Let the rest of the world support the rest of the world's interests.

If John Bolton is confirmed as U.N. ambassador, he'll be one of the primary links with the international community. Please call your Senator today and ask her to vote against John Bolton as U.N. Ambassador.

I think Ronnie knew what he was talking about. I found these at a famous quotes site.

Government does not solve problems; it subsidizes them.

Government is like a baby. An alimentary canal with a big appetite at one end and no sense of responsibility at the other.

Controversy Continues Over EPA Mercury Standards

"He who is willing to sacrifice freedom for safety deserves neither freedom nor safety." - Ben Franklin
"One useless man is called a disgrace; two useless men are called a law firm; and three or more useless men are a congress" - John Adams
Politicians and diapers should both be changed regularly and for the same reasons.

As the March 15 deadline nears for the Environmental Protection Agency (EPA) to announce its new rules for governing mercury pollution from power plant emissions (BGW, March 3, 2005), controversy continues to erupt over the validity of the scientific standards being utilized by EPA.

This week, the nonpartisan Government Accountability Office (GAO) reported that the EPA analysis, on which the standards will be based, had distorted its analysis by failing to fully document the toxic impact of mercury on human brain development, learning ability and neurological functioning. The GAO called on EPA to correct its analysis before issuing a final rule.

Last month EPA's inspector general released a report asserting that EPA ignored both scientific evidence and agency protocols in order to set a timetable and standards consistent with the Bush Administration's desire to relieve coal-burning power plants of Clean Air Act requirements that such plants install the newest and best pollution control technology when they expand.

In the report by EPA Inspector General Nikki Tinsley, EPA was charged with setting unrealistically low limits on mercury pollution and then working backwards to justify its upcoming rule.

As for the GAO report, EPA spokeswoman Cynthia Bergman told the Washington Post that the final rule would include comparisons between the impacts as measured by EPA and the impacts measured by its critics. [1]

Environmentalists strenuously object to the Bush Administration's plan to use a cap-and-trade system for mercury pollution, in which an overall limit would be set, with individual plants trading pollution credits. Environmental health organizations argue that such a system has never been used when toxic chemicals are involved.

They say this would allow dangerous levels of pollution to continue to threaten populations both near the power plants and those downwind from the plants.

Mercury contamination of fish has become a serious enough problem that both the Food and Drug Administration and dozens of states have issued health advisories recommending that women of childbearing age reduce consumption of several types of fish, and that they refrain altogether from eating shark and swordfish.

Environmental health groups support a Clinton Administration plan, which called for a 90 percent emissions reduction by 2008. The Bush Administration has proposed a 70 percent reduction by 2018. Despairing of persuading the administration to change the expected rule, environmental groups are gearing up to fight the standard in court.

Dear Friends:

Americans believe that voting counts and that all
votes should
be counted. Yet, in the past several years, many
have come to
question whether all votes actually get counted.
While
technology can bring us almost instant vote counts,
we also
have to ask whether that technology can be tampered
with,
changing election outcomes.

To address this critical issue, I have joined
Senator Hillary
Clinton in introducing the Count Every Vote Act of
2005 (S.450)
in the Senate. Our bill would establish a
voter-verified paper
trail for use by all individuals, including
language minority
voters, illiterate voters, and voters with
disabilities. It
would also mandate national standards in a variety
of areas,
including the registration of voters and the
counting of
provision ballots. All provisions of this
legislation would
take effect no later than the November 2006 Federal
election.

The Help America Vote Act (HAVA) took important
steps towards
electoral reform. Since the enactment of HAVA,
however,
concerns have been raised about the security of
voting machines
and about the inability of voters who use these
machines to
verify their vote and ensure that the vote they
intended was
both cast and counted. In addition, many other
problems in our
election system remain, including long wait lines
to vote, the
erroneous purging of voters, voter suppression and
intimidation, and unequal access to the voting
process.

The integrity of our nation’s elections is the most
fundamental
necessity for the functioning of our democracy.
The strength
and success of America’s democracy depends on fair
and accurate
elections. When I stood with Rep. Stephanie Tubbs
Jones to
protest the Ohio vote count, our goal was to
reiterate this
point -- that every vote counts and should be
counted. The
Count Every Vote Act of 2005 is an important step
in our
continuing effort to create a more perfect union.

If you have any questions about this or any other
federal
matter, I hope you will contact me.

Sincerely,

Barbara Boxer

Parties tonight! Hear Howard Dean and defend the Supreme Court

Can the President lock anyone, anywhere up without a trial? Should women have the right to choose? Should all children have an equal right to a decent education? Must the government pay corporations to stop polluting? Do workers have the right to a union? Is the U.S. bound by war crimes treaties?

These are all questions decided by federal judges. President Bush and the Republican leadership have a plan to change Senate rules so judicial nominees no longer require broad support. If we can't stop them, we'll see a wave of extreme right-wing judges—including Supreme Court justices—who will roll back generations of progress.

That's why we're hosting house parties tonight where MoveOn members will form neighborhood action teams to defend the courts, and then spread the word on other critical issues. At the parties, we'll also join a national conference call with Gov. Howard Dean, and hear an urgent message from Senator Harry Reid, the Democratic leader. It's important, and it's also a fun chance to meet your neighbors. Please sign up for a party near you:
http://action.moveonpac.org/houseparties/

We're expecting 15,000 people at more than 1,300 parties tonight, a strong and encouraging response. If the parties in your area are already full (or there's no party near you) please consider hosting your own party. It's easy, and hosts almost always tell us they're glad they took the plunge. Just click here:
http://action.moveonpac.org/houseparties/newmeeting.html

Why come? We asked some people who already signed up:

"In these troubling times those of us fighting the good fight need to band together, not feel alone and powerless. The hard-right wants us all feeling alone, separated, alienated and disenfranchised. Well, I'm not giving them the satisfaction. This Thursday night, I'm shutting off my corporate-controlled TV and I'm going out to meet actual human beings--to eat, drink and share in each other's company while we figure out how to get our country back!"
-- Matt, Los Angeles, California

"I'm going to a house party, and I'm bringing along 3 friends, because I don't want to have to explain to my kids why I stayed home watching TV, while their civil rights got eroded, their future auctioned off to corporate interests, and their chance of a life in peace sacrificed for oil & wargames."
-- Uli, Miami, Florida

"Although I usually feel that the issues MoveOn brings to our attention are important, like many people, I rarely feel that I have time to get very actively involved. However, I will be attending my first house party tomorrow because I believe that the issue of possible changes to the Supreme Court Justice process has extremely crucial long-term importance for our government and country. This is not a change that could easily be reversed in four years under a new administration."
-- Alison, Somerville, Massachusetts

"It's time to gather together and create a group of sanity in the midst of all this madness."
-- Pam, Portland, Oregon

"Just wondering if there are any progressives left in Mena."
-- Bruce, host of the "Is There Anybody Out There?" party in Mena, Arkansas, which has nine people signed up

Need we say more? Sign up now for a party near you:

http://action.moveonpac.org/houseparties/

We've asked Gov. Howard Dean, the new chair of the Democratic Party, to come and talk about his vision for how we can combine grassroots action with online organizing to create a rising tide of progressive change in America. He'll answer a few of your questions. We'll hear a message from Senator Reid, who is leading the charge to stop right-wing judges. And then we'll ask you to form local teams and make a plan for a massive national call-in day to your senators, who can stop this power grab.

Of course, the judiciary is only one of many areas in which Republican leaders in Congress and the White House are trying to use deception and scare tactics to force through a sweeping right-wing agenda. So beyond judges, we'll ask your team to spread the word about other critical issues like Social Security privatization and the war in Iraq. And at the party, we'll lay out our plan to use our neighborhood organizing to build a foundation for electing progressives to Congress.

It's a bold plan, and it will work -- provided we all pitch in. Hope to see you tonight!

Thanks for all that you do.

--Adam, Justin, Matt, and the MoveOn PAC team

Don't let Cheney "go nuclear"

"He who is willing to sacrifice freedom for safety deserves neither freedom nor safety." - Ben Franklin

Tomorrow, March 10th, the Senate Judiciary Committee will consider the nomination of mining and cattle industry lobbyist William Myers III for a lifetime appointment to the U.S. Court of Appeals—the second highest court in the land. Myers is the first of 20 judicial nominees Bush has re-submitted in his second term. All 20 repeat nominees were rejected last term by Senate Democrats (as compared to the 204 judges they accepted) because these nominees consistently sided with corporate special-interests over the rights of ordinary Americans.

This time, Bush is ready to fight dirty to force these nominees through. Dick Cheney has even threatened to use a parliamentary trick to eliminate the centuries-old rule requiring judges to have broad support in the Senate. This would effectively silence all 44 Democratic senators and the 173 million Americans they represent—the majority of the country.

With the first crucial vote on the first judge in less than a day, we're launching a national campaign to let our senators know that we out here in America are counting on them to hold the line on all 20 of Bush's rejected, corporate judges, and beat back his dirty parliamentary tricks.

The first phase is this national petition that we will hand deliver to your senators before the confirmation votes for the 20 judges. And tomorrow, MoveOn members will host over 1000 house meetings to create local plans to save the judiciary. The courts we have for the next 30 years may depend on your efforts in the next few weeks.

Please sign today:
http://www.moveonpac.org/judges/

To ram his nominees through, Bush is hoping to use a parliamentary trick the Republicans refer to as the "nuclear option." For 200 years, if enough senators strongly objected to a federal judge, they could use a filibuster to force more debate until all their concerns were addressed. That's how Democrats blocked the worst of these 20 nominees last term. Actually changing the rule would require a 2/3 vote of the Senate—and Bush doesn't have near that level of support.

So instead, Vice President Cheney has threatened to abuse his authority as President of the Senate, and just declare that the right to filibuster judges is null and void. If Senate Majority Leader Bill Frist can twist enough arms to get 50 senators to support the ruling, the filibuster is history. For the first time ever, one party would have complete control over judicial nominations, all the way up to the Supreme Court.

Both parties in the Senate were given the power to approve or reject judicial nominations because—above all else—judges must be trusted by Americans on all sides to rule fairly. So why does Bush refuse to send a few replacement nominees both parties can agree on? Why is he so intent on smashing Democratic resistance to these and all future nominees? Because while his presidency will be over in 4 years, the judges he appoints will be on the bench for the rest of their lives. This is Bush's big push to lock in his hard-right, corporate-friendly ideology for decades to come—and that is exactly why we must not back down now.

The whole plot is set into motion tomorrow, with the committee vote on William Myers. We must draw the line here, by stopping Bush's 20 repeat nominees and standing up to the "nuclear option."

P.S. Here's a brief summary of just the first three of the 20 partisan judges re-nominated by President Bush.

William Myers III has never been a judge and spent most of his career as a lobbyist for the cattle and mining industry. [1] He has written that all habitat conservation laws are unconstitutional because they interfere with potential profit. [2] In 2001, Bush appointed him as the chief lawyer for the Department of the Interior. In that role he continued as a champion of corporate interests, setting his agenda in meetings with former employers he promised not to speak with, and even illegally giving away sacred Native American land to be strip mined. [3]

Terrence Boyle was a legal aide to Jesse Helms. As a judge, his signature decisions have attempted to circumvent federal laws barring employment discrimination by race, gender, and disability. [4] His rulings have been overturned a staggering 120 times by the conservative 4th District Court of Appeals, either due to gross errors in judgment or simple incompetence. [5]

William Pryor Jr. served as Attorney General of Alabama, where he took money from Phillip Morris, fought against the anti-tobacco lawsuit until it was almost over, and cost the people of Alabama billions in settlement money for their healthcare system as a result. [6] He called Roe v. Wade "the worst abomination of constitutional law in our history," and has consistently argued against the federal protections for the civil rights of minorities, lesbian and gay couples, women, and the disabled. Two Arabs are chatting. One of them has his wallet
out and is flipping through pictures.

"Yeah, this is my oldest.
He's a martyr.
Here's my second son. He's a martyr, too."

There's a pause...

The second Arab says, wistfully,

"Ah, they blow up so fast, don't they?"
